What is the calfornia law for evicting a tenant without a contract and 3 months of missed rent?

I need my tenant to move out of the property before August 25, 2008 because i am in the middle of a short sale. The tenant claims to be entitled to a 30 day notice and refuses to move out any sooner. We do not have a written agreement but a verbal agreement. The tenant has not paid me rent for the last three months. Do I have more of a fight to do a short eviction? Also, would i be able to get compensated for the months of rent not paid without a contract?

  2. Uw beste weddenschap moet een eigenaar-huurder procureur raadplegen. Mijn begrip is dat de huurder 30 dagenbericht moet worden gegeven tenzij zij in huur nalatig zijn. Als de huurder in schuldvorderingen voor huur is die ik u kunt een 3 dagbericht verstrekken om huur te betalen of op te houden gedacht met (beweging uit) heb. Er zijn specifieke vormen u moet gebruiken en de wet is vrij ingewikkeld in verband met wat u/can' kunt; t doet als het 3 dagbericht doesn' t het werk en de persoon weigeren weg te gaan. Opnieuw, is een snel overleg met een procureur het veiligst.

  4. I heard both #’s a few times. 30 days & also 7 days 2 get out, even though it sounds harsh. what about your local court house? you do have a defence & your entitled to the back rent I would think. talk to your local court

This is the reason you need a contract 1.- call an eviction service now,Give a proper 3 day notice!!(a month to mont tenancy was created once you accepted money,no need for a 30 day notice.Rent delinquency is enough.) 2.- If you get the keys and the house back,then stop the Eviction.LUCKY YOU..(change locks.)About past rent .”forget it IT!
