What are my rights regarding short-assured tenancy contract?
I have a 12 month short-assured tenancy contract but am very unhappy with the property I’m renting. The shower doesn’t work and hasn’t since we moved in 1.5 months ago. Only recently after 3 plumbers have visited has the problem been identified and we’ve been told by the plumber himself that the shower is dangerous. He says that the shower has been installed wrongly with the hot water piper connected to the cold and vise versa. So basically if you turned on the shower expecting to get cold water, scalding hot would come out instead. The letting agency say that all regulations have been passed, but strangely called out an emergency plumber the next day to try and further assess the problem. I just want to know what my rights are if the shower is deemed dangerous. Also we have had so many other problems, are we entitled to some rent refund?

I think your landlord is responsible to have all repairs and the upkeep of your flat, so if I was you I would withhold the rent until all repairs are done…. When you signed the contract the landlord would have had to sign too, you have right when it comes to dangerous appliance in your property
You have to be joking. You want a rent refund because the taps are swapped around? Why don’t you just change the red and blue tap tops over. There is no regulation about which side the hot tap has to be. The agent already sent 3 plumbers in a month and a half, how much more could they do? And you are complaining that they called out an emergency plumber for you anyway even though all regulations have been passed.
You are really just looking for an excuse to welch on your rent, aren’t you.

I suggest you have a look at the tenancy agreement which you signed(you should have a copy). The terms differ slightly in each agreement, but in general terms the landlord is responsible for sorting out repairs. Some( but only some) agreements give the tenant(you) the right to get the reapirs done themselves, with the landlord being responsible for payment. but you MUST READ YOUR AGREEMENT FIRST.
Having said that other agreements are vague….
I suggest you send the landlord/agent a letter setting out your concerns, and if you have any written advise from any of the plumbers send a copy of this with the letter.
It might be worth just telephoning the plumber who said the shower was incorrect, ask him for a written quote fro the required repairs and WHY THEY ARE NECESSARY. If he thinks it will bring him work i’m sure it won’t be a problem.
Might take a while, but usually things in writing get things moving!!!

Good Luck getting out of that one. You know the shower will burn you and you said so. Why would the 3 du*b@$$ plumbers that you had there not fix your problem? If you get burned in the shower it’s just as much their fault if not more than your land lord that may or may not know your shower is to hot for you. And does your contract say that you have the right to have anybody that you want come in your house and do what ever work you want. Your land lords lawyer will have harder questions for you to answer than this,maybe he might ask you if you had a plumber to switch the water lines so you could get out of your contract?
