Legal question about divorce & sale of property?
This is too long & complicated to explain it all. So here’s the abridged version:
I’m divorcing my husband of 21 years.
He’s a @$$. I’m not.
He is in the process of selling a $700,000 house he built for biz in Alaska (where we both live)
My name is not on it or any of his other business property, equipment, etc.
He transferred all his property to a “friend” of his months ago & he’s claiming he has nothing left.
He’s in debt for $800,000. However he has that much & then some in other assets, esp’ after the sale of this house.
He’s got himself a blood sucking lawyer.
I have nothing. I’m getting a lawyer assigned to me through legal aid, but I want to know about this house sale quicker then I’ll find out then waiting on a lawyer to call me.
His lawyer just called me twice to ask me to sign my permission over to my soon to be ex @$$ so that he can go ahead w/the house sale. I know he’d keep the money, pay off some of HIS bills & leave me w/nothing.
I’m not signing anything. She told me though that if I don’t sign she can appeal the courts & have them proceed without me, she said she didn’t NEED my signature. I don’t trust her or him. I’m sure they’re trying to pressure me into signing. The sale is supposed to close escrow next week.
A lawyer is supposed to contact me in a few days to help me w/this, but I have no $ to pay for it now so I’m not sure if I’ll get my answer soon enough.
Can anyone tell me for sure if my @$$ husband & his scum sucking lawyer have the right to appeal the courts to go ahead w/this sale w/o my permission? What CAN they do?
My divorce papers that she quoted says:
“Standing Injunction
…B. The parties shall not dispose of, encumber, transfer, or dissipate any marital property without written consent of the other party or an order from the court. …”
Please, can any one tell me if this means they won’t be able to do anything with this house sale w/o my permission? Does it at least buy me some time? If so how much? Any info would be highly appreciated. Thank you!!!

This house (the monster) IS a house my husband built for business, but bc of the economy he couldn’t sell it for over a year. HE sold OUR home (sweet home) in Dec’ 08, he used ALL of that money to pay off his other business bills & then moved us into this monster house. He just sold it & forced me out. He’s living in the basement apt of this house (the monster) & the buyers already moved in upstairs in the main monster house. So it’s both a business house/property AND also a personal one.

“an order from the court”:….That is what she seeks if you do not sign.
DO NOT SIGN A THING AND DONT EVEN FEEL PREASURED!
tell the lawyer not signing anything and dont, he trying sell everything so nothing left when comes to divorce so cant get half of everything. so dont agree to anything. start record all conversations on the phone, if she rings and not prepared, just say 1moment and i leave the room to more private 1 and grab recorder and make sure she states who she is and about the hubby etc. that way have evidence on ur side when comes to it. grab any evidence can of this sale and any property he gave to his friend, or sold etc.
takes time to get court date even if judge can sign it away but in divorce settlement a judge be relunctant to so without ur signature and u need to allow this sale to go ahead, so dont fall into a trap, sign nothing, record conversations from now on and build up evidence!
may not be ur name on it but no doubt put blood and sweat, paid for bills etc in that house, done it up and made it home, this is what is coming to u in divorce so start play dirty too as they trying sell b4 u get lawyer to advice u, so simply refuse sign anything from now till have lawyer and guide u in what to do!!!

It seems as if they already know that they are able to do so with an order from the court and will do so if necessary. Problem you have is if the house was built for ‘biz’ was it an asset of the biz or for personal use?!? Since you know the sale is supposed to close next week, tell them you will be available to attend the closing, that way you can get a copy of the documents you sign. If it is a business asset, they may not need your signature.
